CCRKBA Lauds Senate Vote To Protect 2A Rights Of Soc.-Sec. Recipients

With a firm control of Congress and the White House, the GOP is seeking to quickly roll back a rule that President Obama began eyeing as early as mid-2015 - one specifically created to "prevent an estimated 75,000 people with mental disorders from being able to purchase a firearm". The legislation will go to President Trump's desk, where he is expected to sign it. "And it deprives those people of their constitutional rights without due process", he said on Tuesday.

Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa, the author of the resolution, argued that the regulation is overly broad.

"It results in reporting people to the gun ban list that should not be on it at all. So it is plainly wrong to claim, as has been said, that if the regulation is disapproved, agencies will no longer have to report prohibited persons", he said. These individuals would be flagged in a federal background check. The vote fell slightly off party lines, passing by a margin of 57 to 43. The VA submitted the names of veterans to the background check system when it was determined they could not manage their own financial affairs. "Even the American Civil Liberties union opposed Obama's overreaching restriction".




"The [Congressional Review Act] we have before us today will make it harder for the federal government to do what we have told them to do for decades, which is to put unsafe people and people who are seriously mentally ill on the list of people who are prohibited from buying a gun".

But supporters of the rule note that a hearing is required to establish the need for a representative payee for social security benefits, and anyone who thinks they've been reported to the firearm background check system in error has the right to appeal.

"Here, the rule automatically conflates one disability-related characteristic, that is, difficulty managing money, with the inability to safely possess a firearm", the organization said.
