Dakota Access Pipeline Set For Completion After Army Engineers' Approval

Black Elk, who works with the Standing Rock Medic & Healer Council, said there were initially hundreds of activists at the new camp but that those who did not want to be taken into custody ultimately chose to retreat.

Hoeven and Sen. Heidi Heitkamp, D-N.D., have both, meanwhile, been pressing for additional federal law enforcement support in the vicinity of the pipeline, where protesters have been camped for the most of 2016 on property managed by the U.S. Army Corps of Engineers.

The pipeline is more than 90 percent complete, save for a segment that would go under the Missouri River.

Kelcy Warren, CEO of Energy Transfer Partners, the Texas-based firm that's building the pipeline, has said that "concerns about the pipeline's impact on local water supply are unfounded" and "multiple archaeological studies conducted with state historic preservation offices found no sacred items along the route". Then in his first week in office, President Trump signed an Executive Order to speed up just such environmental reviews and approvals for large-scale infrastructure projects.

The project's main remaining hurdle is an Army Corps easement it needs to build under Lake Oahe in North Dakota.

Formal charges are pending against Chase Iron Eyes, who's been helping organize opposition to the $3.8 billion pipeline the Standing Rock Sioux says threatens its drinking water. The 1,172-mile, four-state crude oil pipeline is nearly finished, except for a section under Lake Oahe, just upstream of the Standing Rock Sioux Tribe reservation, that's been the focus of the massive protests in recent months.

The Standing Rock Sioux Tribe said late Tuesday it will "vigorously" pursue legal action to ensure the environmental review is followed. In a statement posted on Facebook they said, "We stand ready to fight this battle against corporate interest superseding government procedure and the health and well-being of millions of Americans". The protesters were arrested Wednesday.

"Regardless of this incident it is our desire to continue the dialogue with tribal and camp leaders so that the camps continue to be cleaned and protesters leave prior to the flooding season", Morton County Sheriff Kyle Kirchmeier said in a statement. Some Native American tribes, mainly the Standing Rock Sioux, launched protests against the 1,134-mile oil pipeline's construction.

The 11 documents at issue discuss the amount of oil that would flow out if the pipeline ruptured in various places, according to court papers filed Wednesday evening by Dakota Access LLC.

On January 18, the group launched an initiative, calling upon members of the public to send their comments on DAPL project directly to the Army Corps of Engineers.
