Homeland Security Memos Detail How Trump Could Detain and Deport

Separately, the Trump administration also has asked the 9th U.S. Circuit Court of Appeals in San Francisco to withdraw its earlier ruling that temporarily suspended the travel ban, because a new, superseding order is about to be issued.

Obtained by NBC News, the new directives signed by Homeland Security Secretary John Kelly provide greater detail about two of President Donald Trump's executive orders relating to his campaign promises of building a border wall with Mexico and increasing deportation efforts.

"The President is contemplating releasing a tighter, more streamlined version of the first (order)". "And I will have opportunity to work [on] a rollout plan, in particular to make sure that there's no-one in a sense caught in the system of moving from overseas to our airports".

He said "it's a good assumption" that green-card residency permit holders would be allowed in, as they eventually were a few days after the original order.

The memos would also allow authorities to criminally prosecute parents who are undocumented immigrants if they paid smugglers to bring their children to the United States.

Trump's executive order barred entry to the United States for at least 90 days by people from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen.

Trump said on February 16 that he would issue a new immigration order by next week.

President Donald Trump's initial attempts to clamp down on immigration from seven Muslim-majority countries and refugees, citing security reasons, have ground to a halt amid a judicial backlash and chaos at airports. As a result, Trump is working on a new version of the order.




Trump on Thursday nevertheless hailed the introduction of the travel ban as smooth. For others, he said, "we will have a short phase-in period to make sure that people on the other end don't get on airplanes".

Nevertheless, these hirings would greatly expand ICE, and the memos would allow for Customs and Border Protection to "begin planning, design, construction and maintenance of a wall" - seemingly fulfilling many of Trump's campaign promises, especially those within his August 31, 2016, address on immigration. His memos are copied to officials at Customs and Border Protection, Immigration and Customs Enforcement and the U.S. Citizenship and Immigration Services.

In the memos, Kelly instructed agency chiefs to start hiring 10,000 additional ICE agents and 5,000 more for the Border Patrol, measures that were included in Trump's executive actions last month.

According to the US customs official, 44 people were denied entry at USA airports and another 97 were denied entry at land border ports of entry between January 27, when Trump signed the executive order, and February 3, when a federal judge in Washington state blocked its enforcement.

"Their claim that everyone left voluntarily and this idea that anyone who wants come back can just call up (U.S. customs officials) is just ludicrous", she said.

One plan is to immediately return home Mexican immigrants apprehended at the border pending the outcomes of their deportation hearings, rather than house them on USA property.

The affidavit said the list of 141 individuals has been provided to the State Department.
