Trump Signs Executive Order Directing EPA to Reconsider Obama Water Rule

President Trump is ordering the EPA and the Army Corps of Engineers to'review and consider an court opinion by the late Antonin Scalia that the Clean Water Act should only cover'permanent standing or continuously flowing bodies of water

In a statement Tuesday, NAHB said Trump's executive order "is an important first step toward reworking the flawed regulation and moving toward a more sensible WOTUS rule".

He added that he shook Trump's hand and thanked him after."For me, it was pretty fantastic", he said.The regulation, known as Waters of the United States, was meant to clarify the federal government's authority to oversee and enforce measures to prevent pollution in smaller bodies of water.

On Tuesday, President Donald Trump brought a relatively obscure but important water rule to national attention.

Trump is expected to sign an executive order February 28 that will instruct the Environmental Protection Agency to begin the process of reviewing and rewriting the rule.

"This rule is one of the easiest examples of the Obama Administration's overreach as we heard of vast swaths of land from pothole to pothole being usurped under federal control", he said. He said of the CWR: "It was a massive power grab". Pruitt says he has already set the ball in motion with official action after the executive order was signed. The order also establishes a President's Board of Advisors on HBCUs but leaves much of the budgeting and administration of the initiative for the Department of Education.

Since 1972, the federal government has protected major water bodies like the Everglades and the Apalachicola River under the Clean Water Act.




"What the Obama rule did was it regulated land" and not just rivers and streams, Parrish said.

For the past several years, most ag commodity groups have been actively opposed to the EPA's Water of The U.S. Rule.

While the EPA has been viewed through a heightened partisan lens in recent years, some have noted that Trump's administration seems to take the agency further to the right than former President George W. Bush's ever did. But the environmental group the Sierra Club said Trump's rhetoric and policies show that he "does not care about our clean air, clean water, or a changing climate threatening American communities".

Pruitt also told the agricultural leaders that the federal government will no longer impose one-size-fits-all solutions on the states.

Cosponsored Senator Barrasso's proposal, which provided clear principles and direction for the EPA and ACE to craft a WOTUS rule that takes into consideration positions held by key stakeholders. The intent is to either rescind or revise the rule so that the country's navigable waters are protected from pollution, "while at the same time promoting economic growth, minimizing regulatory uncertainty, and showing due regard for the roles of the Congress and the States under the Constitution". The rule applies to navigable waterways and their tributaries.
