But critics claim that the new order, like the first, amounts to a de facto ban on Muslims entering the country.

Trenga did note that the intent of the President's order can be examined: "T$3 he Court rejects the [administration's] position that since President Trump has offered a legitimate, rational, and non-discriminatory objective stated in EO-2, this Court must confine its analysis of the constitutional validity of EO-2 to the four corners of the Order".

The case is Sarsour v. Trump, 17-cv-00120, U.S. District Court, Eastern District of Virginia (Alexandria).

A federal judge in Virginia has ruled against a Muslim civil-rights group that sought to block the Trump administration's proposed travel ban.

The decision against the injunction comes after federal judges in Maryland and Hawaii blocked the implementation of Trump's executive order nationwide.

The judge highlighted the changes made to narrow the scope of the travel ban after an initial version of the order was struck down by federal courts in January and February. Authorities have said the ban is based on a credible terror threat.

The new travel ban applies only to people in foreign countries without visas or other rights to be in the U.S. For more than one hundred years, the Supreme Court and other courts have held that, under the Plenary Power Doctrine, many constitutional protections - including those under the Establishment, Equal Protection, and the Due Process clauses - do not extend to foreigners outside our borders.




District Court Judge Anthony Trenga's finding that the ban is justified is in direct opposition to rulings in similar cases in Hawaii and Maryland which called the order discriminatory.

"President Trump, hours after Hawaii enjoined the executive order, said three times in 10 minutes, in front of thousands of people and with television cameras pointed in his face, that the new executive order is a watered down version of the first", which courts had said unfairly targeted Muslims, Abbas said.

He rejected the notion that the immigration ban was in any way a discriminatory religious test. These two past decisions keep the order at bay.

"As the Court correctly explains, the president's Executive Order falls well within his authority to safeguard the nation's security", department spokesperson Sarah Isgur Flores said.

White House press secretary Sean Spicer said: "We're confident that the president's fully lawful and necessary action will ultimately be allowed to move forward through the rest of the court systems".

Because we know there had to be one, a federal judge in Virginia ruled in favor of President Trump's revised travel ban, making the opposite decision of judges who have ruled before him and providing ammunition to Justice Department lawyers who are arguing in favor of the ban in several courts across the United States.

The Trump administration will likely find some ammunition for its appeal in Trenga's ruling.
