Travel Ban Legal Battles Continue, As Administration Appeals New Injunction

Recently, President Trump issued another Muslim travel ban that was close to coming into effect until two federal judges, one from Hawaii and the other from Maryland, blocked the ban.

During Thursday's daily briefing with White House reporters, Spicer called the rulings "flawed" and confirmed that the White House plans to appeal.

The president reacted with his usual bluster at a rally Wednesday night in Tennessee, calling the Hawaii ruling "political", berating the 9th Circuit generally and adding, "This ruling makes us look weak, which, by the way, we no longer are, believe me".

The ban was set to go into effect Thursday.

US judge has halted Donald Trump's revised travel ban on citizens of six Muslim-majority nations, hours before it was due to take effect, dealing a blow to the US President who described it as an "unprecedented judicial overreach" and vowed to challenge the order.

The Trump administration filed court papers Friday hoping to salvage its second version of a travel ban, after two judges in separate cases this week found it likely violated the Constitution.

Lawyers for the state of Hawaii, which brought the suit against the Trump administration have yet to respond to the state's filing.

He pointed to statements made by Trump and his associates both before and after the president was elected in November.

Reacting to the development, the White House said the Trump administration would "vigorously defend" the travel ban and would battle its suspension in the federal courts.

Another federal judge in Maryland wrote, "the history of public statements continues to provide a convincing case that the objective of the Second Executive Order remains the realization of the long-envisioned Muslim ban".

The revamped executive order had been due to take effect at midnight (0400 GMT), but a federal judge in Hawaii froze Trump s efforts to close United States borders to nationals of Iran, Libya, Somalia, Sudan, Syria and Yemen for 90 days.




The government says the ban is a national security measure and critics say it is an unconstitutional and bigoted attempt to bar Muslims from entering the country.

Watson also rejected the government's argument that the courts shouldn't look into the "veiled psyche" and "secret motives" of federal decision makers.

He said Hawaii would suffer financially if the executive order constricted the flow of students and tourists to the state. "We're going to keep our citizens safe", the president said. "The danger is clear".

Watson noted that the freeze on the revised travel ban was only temporary, but he concluded that the changes between the first and the second executive orders were not enough.

Arguing the case in Hawaii, Acting Solicitor General Jeffrey Wall said of Trump's comments: "There is a difference between a president and a candidate".

"I think it was an interesting ruling in the sense that the court is taking a very bold statement on saying that the actions in the administration have basically irrevocably tainted any effort to move forward with this travel executive order", Fresco told VOA via Skype.

The judge cited this interview as an example of the "religious animus" behind the executive order and quoted Trump telling Cooper: "We can't allow people coming into this country who have this hatred of the United States".

It was later blocked by a judge in Washington state, a ruling that was upheld by the 9th U.S. Circuit Court of Appeals.

The Justice Department said it will defend the new travel ban, the CNN reported.

"The history of public statements continues to provide a convincing case that the objective of the Second Executive Order remains the realization of the long-envisioned Muslim ban", Judge Chuang wrote.
