Trump claims immunity as President in lawsuit

A Donald Trump supporter who allegedly assaulted young woman during a campaign rally previous year is claiming the president is to blame in his response to a lawsuit against him.

Trump's attorneys said in a court filing on Friday that the then-candidate was not urging supporters to take hostile actions against the demonstrators at the event in Louisville, Kentucky.

"Bamberger had no prior intention to act has he did", the lawyers wrote.

A man who is being sued over an altercation at an election rally is now coming after President Trump.

The three people who claim they were attacked by Bamberger have also accused the Trump campaign of inciting a riot, negligence, gross negligence and recklessness.

At some rallies, the lawsuit says, Trump and his campaign "promised to pay the legal fees of those who - following Trump's urgings - removed the protesters". The plaintiffs argue they were just there to "peacefully protest".




Local news station WDRB in Louisville reported that the man 75-year-old Alvin Bamberger, of OH, filed his counterclaim Friday where he argues that Trump and his campaign "repeatedly urged people attending" the then-candidate's rallies to "remove individuals who were voicing opposition to Trumps candidacy". As such, he claims Trump should be held liable. He admitted that he "physically pushed a woman down the aisle toward the exit" in the letter, according to the lawsuit.

Three people who claim they were assaulted at the Trump rally filed a lawsuit a year ago against Trump, his campaign, Heimbach and Bamberger.

U.S. District Judge David Hale ruled earlier this month there's evidence that could be seen as supporting allegations that the protesters' injuries were a "direct and proximate result" of Trump's actions.

During a rally in Las Vegas, Heimbach claims Trump said that in the "old days", a protester would be "carried out on a stretcher". "It was an order, an instruction, a command".

"Trump kept saying "get them out, get them out" and people in the crowd began pushing and shoving the protesters", he wrote.

They gave 15 defenses of the president, among them, the president "is immune from suit because he is president of the United States"; that the protesters waived their claims by getting tickets to the rally; and that the protesters "suffered no actual injury" while also being "responsible for their own injuries".
