West Virginia House of Delegates Passes Medical Marijuana Bill

The House of Delegates approved legislation Tuesday that would overhaul Maryland's system for regulating medical marijuana while expanding the number of grower's licenses to open the industry to minorities.

The House Criminal Jurisprudence Committee voted 4-2 on Monday to advance House Bill 81, which would decriminalize the possession of up to an ounce of marijuana.

Passing the measure is one of the leading goals of the Legislative Black Caucus this year. The bill passed by the Senate allows patients to smoke it only if a physician finds no other form of marijuana would help.

The WV Medical Cannabis Act (SB 386) was up for passage Monday in the House.




"The Legislature has answered the prayers of many seriously ill West Virginians and their families", said Matt Simon of the Marijuana Policy Project, who is a West Virginia native and graduate of West Virginia University.

House Bill 1350 was amended to postpone until July 2021 any reduction in the $48 million of supplemental admission tax annually distributed to casino communities, and the $33 million provided to non-casino communities across the state. Growers have to pay a $100,000 initial fee that could be renewed after a year for $10,000.

Shott said he also intentionally crafted significant fees for opening a dispensary or begin a medical marijuana growing operation. This differs from the Senate version of the bill and most of the other state medical marijuana programs.

It would have established a state commission to issue identification cards to patients and caregivers and consider the drug's use for chronic or debilitating diseases or conditions.
