Cosby judge declares mistrial as jury deadlocks again

The judge in Bill Cosby's sexual assault trial declared a mistrial after jurors said they were deadlocked after five days of deliberations.

Cosby's wife of almost 50 years, Camille, was seated in the courtroom on Monday for the closing remarks, and watched as the 79-year-old comedian's lead lawyer, Brian J. McMonagle, insisted that the alleged incident between Cosby and Constand was consensual and that their relationship was romantic in nature. How do I describe the counsels for the accusers? Judge Steven O'Neill, who's been overseeing the case, instructed them to keep deliberating in an effort to prevent a hung jury.

O'Neill sent them back yet again - something judges have the discretion to do as many times as they see fit - but by Saturday, after six days of fruitless deliberations, the jury convinced O'Neill that they were never getting to a unanimous decision.

A statement from Cosby's wife, Camille, that was delivered by a spokeswoman called the presiding judge and district attorney "totally unethical".

Andrea Constand is "entitled to a verdict in this case", District Attorney Kevin Steele said at a news conference later Saturday.

At the time, Constand worked at Cosby's alma mater, Temple University.

She added: "I wanted it to stop".

Cosby, who gave the deposition as part of Constand's lawsuit against him, said he got seven prescriptions for the powerful sedative in the 1970s for the goal of giving them to women with whom he wanted to have sex. This was the only case to result in criminal charges against Cosby. I would suggest to you that Andrea Constand is a victim. Schaffer led the 2005 investigation into the allegations that Cosby had drugged and sexually assaulted Constand.

"If the court allows more accusers to testify next time, it might make the difference", said Gloria Allred, a civil rights lawyer representing numerous women accusing Cosby of sexual assault.




Steadfast Cosby supporters can point to juror division as evidence of a prosecution case that was far from open-and-shut.

"Our job in this, as prosecutors, [is to] take on the tough cases", said Steele. In 2000, a woman accused Cosby of groping her.

"Bill Cosby's trial is about much more than Bill Cosby".

She had told jurors that the comedian attacked her after drugging her with pills he said would help her to "relax" during a dinner at his house in 2004.

Camille Cosby sat in the front row, across the aisle from Constand, who didn't react to McMonagle's two-hour closing but smiled at the end of it. Camille Cosby left when it was the prosecution's turn. "This is talking to a lover", McMonagle said of one call that lasted 49 minutes. He had addressed reporters on Friday night to thank the jury for their work and his fans for supporting him. Cosby also admitted that in the past, he'd obtained Quaaludes, a sedative, for the goal of giving them to women in order to have sex with them.

In the deposition, the I Spy star stated that he gave Constand three half-tablets of Benadryl before the touching began. If he were convicted, he could face up to a 10 years in prison.

"We commend those prosecutors", they continued, "who raised awareness that one of the hallmarks of drug related sexual assaults is the affect the drug has on the victim's memory and ability to recall and were nonetheless willing to present this evidence to the jury".

Cosby was charged with three counts of aggravated indecent assault.
