After Trump fired FBI Director James Comey on May 9, Rosenstein appointed Mueller as a special counsel to oversee the FBI investigations into Russia's attempts to interfere with the 2016 election, and any signs of collusion between the Trump campaign and Moscow.

"I'm not going to follow any orders unless I believe those are proper and appropriate orders", he said.

Regarding testimony by fired FBI Director James Comey, Sessions said Comey told him after talking to the president that he was concerned about proper communications protocols between Justice and the White House.

Rosenstein is the only person who can fire Mueller under current Justice Department regulations - though those regulations could theoretically be set aside.

"I am protecting the right of the president to assert it if he chooses, and there may be other privileges that apply", he said.

Rosenstein's memo to Sessions about Comey was originally used to justify Comey's firing - although Trump undercut that a few days later, when he told NBC News that he fired Comey because of the Russian Federation probe.




They say Trump did not collude with Russian Federation and see the investigation as a politically motivated sham that handicaps Trump's ability to execute his agenda, according to one person who advises the White House on how to handle the probe.

But Trump has made no decision to act against Mueller and insists he knows the risks of doing so - but people close to the president say Trump is so volatile they can not be sure that he will not change his mind if he finds out anything to lead him to believe the investigation has been compromised.

The talk about dismissing Mueller appeared to be coming from Trump allies - including some close to White House strategist Steve Bannon - who are increasingly frustrated with the prospect of a long and winding probe.

The poll also found that 43 percent of voters thought Comey's testimony last week before the Senate Intelligence Committee hurt Trump more than helped the president.

Investigations are now under way into Russian meddling in the 2016 election.

And while he had recused himself from the Russian Federation probe, Sessions insisted, "I did not recuse myself from defending my honor against scurrilous and false allegations".

On Tuesday, Sessions said Comey never told him the specifics of that February meeting.

"I recused myself from any investigation into the campaigns for President, but I did not recuse myself from defending my honor against scurrilous and false allegations", Sessions said.

"I think the best thing to do is to let Robert Mueller do his job".

The AG refused to disclose whether he discussed fired FBI Director James Comey's handling of the FBI's Russian Federation probe with Trump before the president terminated Comey.
