Trump revised his travel ban to ensure a Supreme Court showdown

Another US appeals court keeps US President Donald Trump's travel ban blocked

"Intl-Regugee-Assistance-Amicus_6.9.17.pdf">brief filed by the nonprofits Center for Competitive Politics (CCP) and Public Policy Legal Institute (PPLI) urges the high court to grant review of a lower court decision that struck down Trump's executive order banning travel to the U.S.by individuals from six Muslim-majority countries.

According to Reuters, challengers to the ban had said in court papers that it should have expired on Wednesday, 90 days after the executive order was due to take effect on March 16. The court is now considering an emergency request from the administration seeking to put its travel ban into effect while litigation continues.

The president's revised order seeks to ban travel from Iran, Libya, Somalia, Sudan, Syria and Yemen for at least 90 days, and temporarily halt all refugee applications for 120 days.

The court was responding to a request made by Acting Solicitor General Jeff Wall, who said in a letter that the ruling on Monday by the 9th U.S. Circuit Court of Appeals in San Francisco means the government needs to file a new brief.

The president approved the changes in a memo as the high court considers whether it will allow the long-stalled ban to take effect. "We need the Travel Ban as an extra level of safety!" The 9th U.S. Circuit Court lifted that narrow part of their stay on the executive order while maintaining other stays that prevent wider implementation.

"We have asked the Supreme Court to hear this important case and are confident that President Trump's executive order is well within his lawful authority to keep the nation safe and protect our communities from terrorism", Justice Department spokesperson Sarah Isgur Flores said at the time.

Specifically, Trump is seeking review of recent Ninth and Fourth Circuit court opinions upholding injunctions on the enforcement of the travel ban arising out of district courts in Hawaii and Maryland, respectively. "In fact, he called upon leaders in the Muslim world to join the United States in protecting religious freedom for all, including the freedom to be free from violence and terror", Sessions said.

The terms of the revised executive order state that a ban will be applied to travelers from any country that does not cooperate with US officials to determine whether that country provides sufficient information about its nationals to assure "that the individual seeking the [visa, admission, or other] benefit is who the individual claims to be and is not a security or public-safety threat".

CCP waded into one recent case, Susan B. Anthony List v. Driehaus decided by the Supreme Court in 2014, which ruled in favor of challengers to an OH law prohibiting false statements during a political campaign.
