Another Turnbull government minister has dual citizenship - but won't stand aside

Government Senator Fiona Nash revealed yesterday she is a United Kingdom citizen by descent because of her Scottish-born father. Travel records show the elder Xenophou travelled to Australia in 1951 as a British citizen, the ABC reports. "The suggestion that I could be a British citizen is something that would absolutely horrify my father", Mr Xenophon told The Australian newspaper.

Senator Nash said she made her own inquiries with the UK Home Office on Monday, following Barnaby Joyce's statement regarding his citizenship.

Ms Nash said she has had legal advice that she had not breached rules.

It would make him the seventh parliamentarian caught up in a growing dual citizenship crisis after Senator Nash and Deputy Prime Minister Barnaby Joyce, both who are not resigning their position after receiving advice from the Solicitor General.

Amid the dual citizenship scandal involving a number of Australian MPs, a Sydney barrister has claimed that, a section of the federal constitution could arguably disqualify everyone from parliament. and New Zealand is to blame for that.

Mr Pitt wouldn't comment on Senator Nash's situation as it would now be referred to the High Court once parliament resumed on September 4.




There are the two resigned Greens senators, Scott Ludlam and Larissa Waters. However, that case also found that "it would be wrong to interpret the constitutional provision in such a way as to disbar an Australian citizen who had taken all reasonable steps to divest himself or herself of any conflicting allegiance".

"Under recent and little-noticed changes to New Zealand law, Australian citizens now don't need a visa to live, study or work in the Land of the Long White Cloud".

Nash's case illustrates how far section 44 (i) can reach.

A court will determine if the deputy Prime Minister is still eligible to hold office, while the careers of a number of other politicians are now in question. That election backfired for the government, however, leaving it with a bare one-seat majority in the lower house and only 29 seats in the 76-member Senate.

Earlier, Australian Conservatives Senator Cory Bernardi, a former Liberal, called for Parliament to be suspended until the crisis is resolved.
