Trump Asks US Supreme Court to Restore Refugee Travel Ban

The Justice Department wants to stay part of the appellate decision that said refugees should be allowed to enter if they have formal assurances from resettlement agencies that they will provide services when the refugees arrive.

The Justice Department's high court filing Monday follows an appeals court ruling last week that would allow refugees to enter the United States if a resettlement agency in the USA had agreed to accept their case.

The ruling on refugees "will disrupt the status quo and frustrate orderly implementation of the order's refugee provisions that this court made clear months ago could take effect", acting Solicitor General Jeffrey Wall wrote.

The Supreme Court is scheduled to hear arguments in October about whether Trump's travel ban discriminates against Muslims, in violation of the U.S. Constitution.

US officials can at least temporarily continue to block refugees with formal assurances from resettlement agencies from entering the United States after the Supreme Court intervened again Monday to save a piece of President Donald Trump's travel ban. An appeals court earlier restricted Donald Trump's effort to temporarily bar most refugees to enter the soil of United States.

The administration is not challenging the part of the ruling that applies to a temporary ban on visitors from six mostly Muslim countries.

The dispute taken to the justices Monday addresses how much of the travel ban can be enforced until the Supreme Court rules on the broader issues.

"This Court's ruling can not plausibly bear that construction, which would as a practical matter render the partial stay this Court granted as to the refugee provisions a dead letter", the administration said.

The travel ban bars people from Iran, Libya, Somalia, Sudan, Syria and Yemen from entering the US.

Permitting the ban to expire would let the administration save face while avoiding the risk of a damaging Supreme Court decision that could not only strike down the order but also place lasting constraints on presidential power over immigration and national security.

By that point, the original 90-day travel ban will have lapsed and the 120-day refugee ban - with certain allowances by the Trump administration for special cases - will have just a few weeks to run.

Trump administration lawyers told justices on Monday that changing the way it enforces the policy on refugees would allow "admission of refugees who have no connection to the United States independent of the refugee-admission process itself".
