Donald Trump would be impeached if he pardoned himself: Rudy Giuliani

Special Counsel Robert Mueller is sensitive to pulling "another Comey" as the Russian Federation probe enters its final months, Trump attorney Rudy Giuliani said in an interview Sunday.

When asked whether Trump has the power to pardon himself, Giuliani replied, "he probably does".

When pushed, however, Giuliani said he generally agrees that the president has stunningly broad powers - even if using them would be political suicide. I think it would probably get answered by, 'gosh that's what the Constitution says.' And if you want to change it, change it. The attorneys then present the relevant interview transcript in its entirety to show that Trump knew that the Russian Federation investigation would likely be protracted if he fired Comey, but that he had "to do the right thing for the American people".

Trump's lawyers have been building a legal argument since late last summer for why Mueller shouldn't be able to question Trump, the details of which were outlined in a confidential January memo to Mueller that was leaked to the New York Times over the weekend. "Pardoning other people is one thing, pardoning yourself is tough".

"If the President decided he was going to pardon himself, that's nearly self-executing impeachment".

In addition to the legal battles, Trump's team and allies have waged a public relations campaign against Mueller and the Justice Department to discredit the investigation and soften the impact of the special counsel's potential findings.




Trump jabbed at the Justice Department via Twitter on Sunday morning, going so far as to put "Justice" in quotes. Giuliani based that claim on his reading of the Constitution, and the fact that the Attorney General is appointed by the President (though AG Jeff Sessions has recused himself from the investigation). He went on to describe such a move as "unthinkable" and said it would probably lead immediately to impeachment.

The question came up when host George Stephanopoulos asked about why the Trump camp kept changing its answer about whether the president played a role in drafting a July 8, 2017 statement to the New York Times about Donald Trump Jr. In other words, even if the president fired Comey (or Mueller) exclusively to protect himself from criminal liability, it's all perfectly legitimate. I think under circumstances where there's no - at best there's ambiguity as to whether there was intent.

"It could lead to impeachment", Giuliani said, referring to the idea of Trump pardoning himself.

President Donald Trump's personal lawyer made the bold claim that even if the president committed murder he still could not be indicted for his crime.

But that's all the president's decision.

In the letter, attorneys argued that the president couldn't have obstructed justice because he has authority over all federal investigations. The document also argues that Trump "could, if he wished, terminate the inquiry, or even exercise his power to pardon if he so desired". "I'm not billing by the hour, otherwise I could tell you exactly", he joked about the case he has taken on for free.
