Trump vows to terminate birthright citizenship

President Trump vowed Wednesday that birthright citizenship will end "one way or the other", a day after it emerged he was considering killing the policy by executive order - a development that sparked disagreement among Republicans and condemnation from Democrats.

While Trump asserts that he can change the provision with such an order, that is far from certain: there is a set process for modifying the constitution, which does not include presidential decree.

Trump's statements came with the midterms just one week away and amid an onslaught of anti-immigrant rhetoric from the president.

"It was always told to me that you needed a constitutional amendment".

"If President Obama can get DACA approved. we can do this by executive order", Trump said.

Under the Constitution's 14th Amendment, enacted in the wake of the Civil War to ensure that black Americans previously subject to slavery had full citizenship rights, citizenship is granted to "all persons born or naturalized in the United States".

Legal scholars have had much to say about the 14th Amendment over the years, including U.S. Court of Appeals Judge James Ho-who, in 2011, declared, "Opponents of illegal immigration can not claim to champion the rule of law and then, in the same breath, propose policies that violate our Constitution".

Trump says White House lawyers are reviewing his proposal.

And he has called on Mexico to halt groups of Central American migrants - which he has repeatedly vilified in campaign speeches - that are traveling through the country to reach the United States.




Trump repeated his claim that he can eliminate birthright citizenship via executive order later Wednesday, although he said his preference would be for Congress to pass legislation ending that constitutional right.

On Monday, Trump described the migrant caravan as an "invasion on our country" as his administration announced plans to deploy at least 5,200 troops to the border by the end of this week.

We'll have more on Trump's attempts to circumvent the 14th Amendment's birthright citizenship clause after headlines with historian and author Martha Jones.

Mr Trump had earlier called the birthright policy "ridiculous" and incorrectly claimed the United States was the only country to offer it.

Napolitano, though, said the only way that birthright citizenship can be altered is through a Constitutional amendment.

And in his interview with Axios, the president described how immigrants can take advantage of the policy.

"Birthright citizenship defines who we are as a nation and is a core part of our American heritage and history".

In 1898, however, in the case of a man born in San Francisco to Chinese immigrants who lived permanently in the United States, the court ruled that the government could not deny him citizenship. "We - House Republicans and this President - are in total agreement on the need to stop illegal immigration, to secure our border and fix our laws". "Guess what? You don't", he said, adding that he has run it by his counsel.

"The President does not have the power to erase parts of the Constitution, but he and the GOP Congress have spent two years trying to erase protections for people with pre-existing conditions", Ms. Pelosi said.
