Three people from northern California have reportedly sued Apple as they say that there iPads that belong to apple stop working within minutes when being exposed to the sunlight.
The complaint is filed by Jacob Balthazar, Claudia Keller and John Browning in the federal court in Oakland on July 23.
Its written in the case filing that “The iPad does not live upto the reasonable consumer’s expectations created apple insofar as the iPad heats up so quickly in the normal weather conditions that it does not function for prolonged use outdoors, or in many other warm conditions.”
According to the company claims when the device is kept in sun for too long then it shuts down to prevent itself from any damage and the screen reads “iPad needs to cool down before you can use it.” but, according to the complaint it happens just in mins after the device is being exposed to sun.
This can result out to be a big problem since the device has been designed for e-book reading and outdoor mobile computing but if the device cannot work in sun then how will it live upto the company’s promises.
The consumers who have sued the company have accused the company of fraud, negligent misrepresentation, deceptive advertising practices, intentional misrepresentation, breach of warrenty and unfair business practices under Unfair Competition act. The group has demanded a trial by jury and intend to punish the Apple with punitive damage which will give an example to others who who might intend to do such fraud.
The complaint also says “nowhere does Apple mention that the iPad is virtually unusable when sitting in particular environmental conditions since it turns off, sometimes just after a very few minutes of use. Despite of all these problems the iPad is not facing any kind of slowdown in its sales and continues to sell.
